OCPS PARENTS of ESE students - Please read the following:
The Office of Special Education and Rehabilitative Services (OSERS) has recently instituted a new ruling that requires districts to distribute written notification on an annual basis informing parents that under IDEA (Individuals with Disabilities Education Act) and FERPA (Family Educational Rights and Privacy Act) they are to obtain a one-time parental consent prior to disclosing personally identifiable information maintained in student’s education records. This notification is required in order to receive Medicaid reimbursement for health-related services provided to Exceptional Student Education (ESE) students.
Parent/Guardian Rights:
- Individual Education Plan (IEP) and Individual Family Services Plan (IFSP) services must be provided at no cost to the parent/guardian or student.
- Services listed in the IEP/IFSP must be provided whether or not parents give consent for OCPS to bill Medicaid.
- Medicaid consent may be withdrawn at any time by submitting a new Medicaid Parental Consent Form. Contact your school’s staffing specialist to make this change.
- Annual written notification of parental/guardian rights regarding this consent must be provided by the school district.
- Copies of records disclosed as a result of authorization to bill will be made available to parent/guardian upon request.
